Niels Eberle studied law at the Humboldt University in Berlin. Niels Eberle began his legal career in the law firm of an international auditing company in Berlin. The focus of his work there was on the areas of corporate, real estate and capital market law as well as tax law. In 2010, he joined Heither & von Morgen Partnerschaft von Rechtsanwälten mbB, a law firm specialising in labour, commercial and corporate law, of which he became a partner in 2015.
In corporate law, Niels Eberle advises and represents companies, managing directors, shareholders and company founders in all phases (foundation, drafting of contracts, restructuring, changes in shareholdings, crisis, liquidation) of all types of companies and all forms of shareholdings. In doing so, Niels Eberle benefits from his experience in and successfully completed theoretical training as a specialist lawyer for tax law. This is because tax law motives or consequences play a significant role in almost all corporate law issues and circumstances, from the decision for the "right" corporate form to liquidation. The awareness of problems in this area enables Niels Eberle to point out problems to his clients at an early stage and to ensure effective communication and cooperation with the client's tax advisor.
In addition, Mr. Eberle advises buyers and sellers on share deals, asset deals and transactions under transformation law (mergers, spin-offs, spin-offs, split-ups, change of legal form).
A further focus of Eberle's activities is the representation of shareholders and managing directors in disputes with co-shareholders, co-managers and other bodies. This includes advice and representation in shareholders' meetings and in advance of such meetings, as well as representation in court disputes, such as actions for damages, nullity and rescission actions, and proceedings for exclusion, dismissal, termination, resignation, etc.
Mr. Eberle is also active in the field of company pension schemes. Here Niels Eberle advises and represents board members, managing directors, employees and employers with regard to pension commitments and company pension adjustments.
In the field of receivables management and enforcement, Mr. Eberle asserts receivables for private individuals and companies.
In addition to his work as a lawyer, Niels Eberle is a drummer. Before working as a lawyer, he worked as a studio and live drummer for numerous Berlin bands and as a drum teacher. He played concerts and tours in Germany, Austria, Switzerland and Belgium and released several CDs with his bands, which were produced in studios in Berlin and Chicago.
